Delhi HC restrains use of infringing mark "Devtol": Suit filed by owner of trademark "Dettol"

The Delhi High Court on May 28, 2020 {RECKITT BENCKISER (INDIA) PVT. LTD. vs MOHIT PETROCHEMICALS PVT. LTD. & ANR.} held that the plaintiff is a manufacturer of a well-known antiseptic which is sold under the registered trademark and logo “Dettol”. 

In the present case, the plaintiff has approached the Court seeking various reliefs against the infringing mark and logo i.e. “Devtol”. At the outset, the statement was made by the defendants, to the effect, that they will not manufacture and/or sell the product i.e. the hand sanitizer under the infringing mark. The defendants also submitted that they have already written to their agents and dealers to withdraw the product bearing the infringing mark from the market.

The Single Judge of HC, Justice Rajiv Shakdher, in view of statement made by the defendants, decreed the suit, and further directed the defendants to deposit a sum of Rs. 1,00,000/- to the Juvenile Justice Fund maintained in the name of the Registrar General, High Court of Delhi, New Delhi within one week.
